The CMT proposes to regulate ten underwater cable routes
The Commission de the Market de Telecomunicaciones (CMT) has proposed to regulate the ten underwater cable routes without alternatives to Telephone. These routes are those that connect the Peninsula with Ceuta and Melilla; the Peninsula with the Canary Islands; the Canary Islands to each other; Majorca with Menorca; and Ibiza with Formentera.
The unique way that has the alternative operators to accede to the territories without alternative infrastructures is to use underwater cables de Telephone, since the use de technologies as the satellite does not replace de trustworthy form the transmission by optical fiber. This dependancy turns to the underwater cable into a “neck de bottle” that can affect negatively to the competition in the territories that they connect. In this sense, the CMT has verified that in these territories the quota de market de Telephone in broadband is superior to the one de the rest de the State enough and, in the case de Ceuta, clears the 100%.
In order to facilitate that in these territories it is possible to be enjoyed the same variety de supplies de services de telecommunications (especially broadband) that in the Peninsula, one sets out to force Telephone renting the underwater cable systems in these routes to reasonable prices, that will have to count on the approval de the Commission. The CMT already regulated in September the conditions de benefit de the underwater cable from the Peninsula to the Canary Islands (the prices stooped a 30%). Now, after a national analysis, the CMT proposes to extend the regulation to other nine routes, besides maintaining the conditions established in September for the route Peninsula, the Canary Islands.
Leased lines for companies: to foment the competition by means de the regulation adapted in the wholesale market
The advice de the regulator also has analyzed the retail services de the leased lines, that consist de a permanent connection and with fixed capacity between two points. These services are fundamental in the company communications. Therefore, to foment the competition in these markets is beneficial to improve the services de telecommunications that are lent, consequently, to the companies and for their competitiveness.
In this sense, the leased lines de up to 2 Mbit/s de capacity (denominated the minimum set) were also regulated de retail form. After analyzing the behavior de the market, one has reached the conclusion that the wholesale regulation is sufficient to foment the competition in the retail segment. de this form a greater flexibility at the time de making the retail supplies for the final clients is allowed.
Therefore, the CMT proposes to suppress the regulation in the retail market de leased lines, in accordance with the recommendations de the European Commission. In the wholesale plane, the effective regulation will stay. Telephone, the operator with being able significant de market has a quota de 65%. This operator will have to continue defering, de wholesale form, leased lines to prices regulated to the rest de operators. He is remarkable that sets out to maintain the regulation wholesale de the Ethernet lines, fundamental piece de the advanced services de communications for companies. The CMT was one de the first European regulators in imposing obligations for this type de lines in the previous revision de the market.
On the other hand, one de the new features introduced now is that the leased lines wholesalers de Telephone not only could be used to connect enterprise clients but also they could be used by the movable operators to connect his stations bases (known by its abbreviations in English BTS), in the conditions established by the CMT.
With these initiatives, the regulator tries to wholesale foment the competition in the development de new infrastructures de leased lines main and the segments de completion de rented lines. The proposals are framed in the process de market analysis. From now on, a month de term is abre so that the agents de the sector and the National Commission de Competition present/display their allegations before the proposal is sent to the European Commission.
